Louisiana High Court Tosses $1.2M Award Against State’s Insurance Commissioner

BATON ROUGE, La. - In a 6-1 decision, the Louisiana Supreme Court on Oct. 14 threw out a $1.2 million award to the alleged owner of American National Agents Insurance Group (ANA) because the claimant did not have a right to pursue a breach of fiduciary duty claim against the state’s insurance commissioner for his involvement in the company’s liquidation (James H. “Jim” Brown v. ANA Insurance Group, No. 2007-2116, La. Sup.).

Walgreens Pays $9.9 Million To Settle Medicaid Billing Claims

MINNEAPOLIS - Walgreen Corp. has agreed to pay $9.9 million to the federal government and four states to resolve allegations of improperly billing Medicare for prescription drugs dispensed to people who were covered by both Medicare and private third-party insurance (United States ex rel Neil P. Thompson and Daniel J. Bieurance v. Walgreen Co., No. 05-SC-759, D. Minn.).

Court: Smoking, Asbestos Caused Cancer; Claimant Half Liable

PERTH, Australia - An Australian high court on Sept. 26 found that a former asbestos pipe fitter’s lung cancer was 50 percent attributable to his cigarette smoking, setting aside a trial court ruling that found an increased risk of 10 percent where the risk was a combination of asbestos and tobacco smoke (The State of South Australia v. Ellis, No. [2008], WASCA 200, Western Australia Sup. App.; See January 2007, Page 4).
