PASADENA, Calif. - A California federal judge abused her discretion when she relied on a mortgage company's uniform exemption policy "to the near exclusion of other factors relevant to the predominance inquiry" in considering a motion to certify the class in an overtime suit, the Ninth Circuit U.S. Court of Appeals ruled July 7 (In re: Wells Fargo Home Mortgage, No. 08-15355, 9th Cir.; 2009 U.S. App. LEXIS 14864).
