ATLANTA - An ERISA-governed disability insurer that denied benefits to a claimant with fatigue, weakness and muscle pain acted reasonably, the 11th Circuit U.S. Court of Appeals ruled Oct. 2, finding that the insurer properly considered the claimant’s subjective complaints of pain, doctor reports and medical reviews (Susan Keith v. The Prudential Insurance Company of America, No. 09-10695, 11th Cir.; 2009 U.S. App. LEXIS 21704).
