2nd Circuit Denies Dismissal Of Appeal Regarding Arbitration Panel Status
NEW YORK - In the appeal of a lower court's vacatur of its earlier order regarding the status of an arbitration and the composition of an arbitration panel after one of the panel's members resigned for health reasons, a Second Circuit U.S. Court of Appeals panel on Jan. 21 denied the reinsured's motion to dismiss the appeal on jurisdictional grounds and granted the reinsurers' motion to stay the arbitration pending appeal (Insurance Company of North America, et al. v.
